2. Applicability
These General Terms and Conditions apply to all offers, orders and agreements between Forelle and consumers.
These terms are made available before an order is placed. The customer can save or print these terms.
If any provision conflicts with mandatory consumer law, the applicable consumer law shall prevail. The remaining provisions shall remain valid.
Any deviating agreements are valid only when confirmed by Forelle in writing.
3. Offers and Product Information
Forelle makes every effort to display products, prices, images, sizes and other information as fully and accurately as possible.
Product images are intended as a representative display. Minor differences in colour, finish, packaging or design do not constitute a defect if they do not affect the normal use of the product.
Products made from natural materials, such as wooden bats and leather gloves, may differ in colour, grain, texture, weight and finish. These natural variations do not in themselves constitute a product defect.
Obvious writing, input or pricing errors are not binding on Forelle if the customer could reasonably have understood that an error had occurred.
Stock information is kept as up to date as possible but may differ due to orders being placed simultaneously.
4. Orders and Agreements
The customer places an order by completing the ordering process on the website and confirming the order.
The automatic order confirmation only confirms that Forelle has received the order. The agreement becomes final when Forelle accepts the order, sends a shipping confirmation or begins fulfilling the order.
Forelle may refuse an order in cases including:
- insufficient stock;
- a pricing or product error;
- incorrect or incomplete customer information;
- suspected fraud or misuse;
- an undeliverable shipping address.
If a paid order is not accepted, Forelle will refund the amount received as soon as possible.
5. Prices, Discounts and Payment
The price displayed when the order is placed shall apply. Consumer prices include the applicable VAT unless stated otherwise.
Standard shipping costs are shown before the order is completed. Some heavy equipment items, such as pitching machines, are indicated to have additional shipping costs.
Discount codes, Team Buyer prices and other promotions cannot be combined unless Forelle expressly states otherwise. Discounts cannot be applied retrospectively to an order that has already been placed. Some products are exlcuded from discount coupons & other promotions. You may read more on this in our FAQ Discount section.
The available payment methods are shown during checkout.
If payment is not made on time, the customer will first receive a payment reminder with an additional payment period of fourteen days. After this period, the order will be cancelled.
6. Delivery
Forelle delivers to the address provided by the customer during the ordering process. The customer is responsible for entering the delivery address correctly.
Forelle will deliver within the agreed period. If no delivery period has been agreed, the order will be delivered within thirty days at the latest.
Stated delivery times are estimates and not guaranteed final delivery dates unless expressly agreed otherwise.
If delivery is significantly delayed, the customer may give Forelle a reasonable additional period in which to deliver. If Forelle also fails to deliver within this additional period, the customer may cancel the agreement.
The risk of loss or damage remains with Forelle until the customer or a person designated by the customer has received the order.
Visible transport damage should preferably be reported to Forelle as soon as possible. Failure to report damage immediately does not limit the customer’s statutory rights.
7. Statutory Right of Withdrawal
For an online purchase, the customer has the right to withdraw from the agreement within fourteen days after receipt without providing a reason.
The customer may notify Forelle of the withdrawal through:
- the online withdrawal button in the customer account (RMA module);
- an email to [email protected];
- the model withdrawal form;
- another clear written statement.
Using the return or withdrawal form is not mandatory, but it is strongly recommended to ensure that the return can be processed quickly.
After delivery, the customer has fourteen days to return the product or hand it in at the showroom.
The customer may inspect and try on the product as they would be able to in a physical store. If the product has been used beyond what is necessary to assess it, Forelle may deduct a demonstrable reduction in value.
The direct return shipping costs are paid by the customer unless the product was delivered incorrectly or with a defect, or Forelle has stated otherwise.
8. Refunds Following Withdrawal
Forelle will refund the purchase amount no later than fourteen days after receiving the withdrawal notification.
Forelle may postpone the refund until the product has been received or until the customer provides evidence that the product has been returned.
If the entire order is withdrawn, the costs of the least expensive standard delivery method offered will also be refunded.
Additional costs for a more expensive delivery method will not be refunded.
The refund will be made using the same payment method used for the original order unless otherwise agreed.
9. Additional Return Period
In addition to the statutory right of withdrawal, Forelle offers a voluntary return period of ninety days after receipt for most online purchases.
After the statutory withdrawal period has expired, products will only be accepted if they:
- are unused, unworn and unwashed;
- are clean, complete and undamaged;
- include all original labels and accessories;
- are, where reasonably possible, in the original product packaging;
- can be resold as new.
For returns made after the statutory withdrawal period, the original shipping costs will not be refunded.
For purchases made entirely in the showroom, Forelle voluntarily offers a return period of thirty days after purchase. The product must be unused, complete and suitable for resale as new. Valid proof of purchase is required.
These voluntary return policies do not limit statutory rights relating to an incorrectly delivered or defective product.
10. Exceptions to Returns
The statutory right of withdrawal does not apply to products made according to personal specifications or products that have clearly been personalised, such as products featuring a name, number, logo, print or individual custom configuration.
The right of withdrawal may also be excluded for sealed products that are unsuitable for return for health protection or hygiene reasons if the seal has been broken after delivery. Opening normal product packaging is not automatically the same as breaking a hygiene seal.
Products that have been used, damaged or made incomplete during the statutory withdrawal period cannot automatically be refused. Forelle may, however, deduct a demonstrable reduction in value.
11. Return Address
Returns can be sent to:
Forelle B.V.
Marie Curieweg 2
6045 GH Roermond
The Netherlands
The customer is expressly requested to include the order number and contact details with the return shipment.
Use of the Forelle return form is recommended to speed up processing, but it is not mandatory during the statutory withdrawal period.
The customer is advised to use a traceable shipping method and retain proof of shipment.
12. Statutory Guarantee
The customer is entitled to a statutory guarantee period of two (2) years. This means that a product must meet the reasonable expectations of the customer.
The following factors are taken into account when making this assessment:
- the type of product;
- the product description;
- the price;
- normal use;
- the expected lifespan;
- the properties of the materials used.
The statutory guarantee is separate from any additional guarantee offered by Forelle or the manufacturer. An additional guarantee does not limit the customer’s statutory rights.
Normal wear and tear, damage caused by misuse, insufficient maintenance, accidents, improper storage, unauthorised alterations or use for another sport or application are generally not covered by the guarantee.
The customer must report a discovered defect within a reasonable period. A report made within two weeks after discovering the defect is considered timely.
13. Warranty Exclusions
The statutory guarantee does not apply in the following cases:
- Products that have been used incorrectly, unsafely or contrary to the instructions for use;
- Products that have been altered, repaired or modified without permission;
- Products that have been used intensively by multiple people or as team equipment and have therefore suffered excessive wear;
- Products that have been used for a sport or application other than the one for which they were designed;
- Wooden and composite bats, unless expressly stated otherwise;
- Baseball and softball bats described as “dead”, “flat” or having “lost their pop”;
- Bats that do not or no longer meet the certification requirements of the relevant competition;
- Normal wear or damage to bat grips;
- Torn or worn toe areas caused by pitching, sliding or toe drag;
- Helmet liners, unless there is a demonstrable manufacturing or material defect at the time of delivery.
14. Warranty Procedure
A warranty claim can be submitted via [email protected]. Always include the information listed below to ensure the correct and timely handling of your warranty claim.
- the order number or another form of proof of purchase;
- a clear description of the issue;
- clear photographs or videos;
- information about how the product was used and how the issue occurred.
If a physical assessment is required, the customer will first receive return instructions from Forelle. Products submitted for warranty inspection must therefore not be returned without prior instructions.
If the product does not comply with the agreement, Forelle will offer an appropriate statutory solution. Depending on the circumstances, this may include repair, replacement, delivery of a missing part, an equivalent product, a price reduction or a refund.
15. Complaints
Complaints can be sent to [email protected].
Please preferably include the order number, a clear description of the complaint and any relevant photographs or documents.
Forelle will confirm receipt of the complaint as soon as possible and will aim to respond within fourteen days.
If more time is required, the customer will be informed within fourteen days.
Forelle and the customer will first attempt to resolve the complaint through mutual consultation.
16. Liability
Forelle is liable for damage to the extent that such damage can be attributed to Forelle under applicable law.
Forelle is not liable for damage caused by incorrect or unsafe use, failure to follow instructions, insufficient maintenance, normal wear and tear, unauthorised alterations or use for an application for which the product was not intended.
Nothing in these terms limits liability that cannot be excluded under mandatory law.
17. Personal Data
Forelle processes personal data for purposes including order fulfilment, payments, deliveries, customer service, fraud prevention and compliance with legal obligations.
More information can be found in the Privacy Policy on FORELLE.COM.
18. Amendments
The version of the General Terms and Conditions available at the time the order was placed shall apply to that order.
Subsequent amendments do not apply retroactively to orders that have already been placed.
If any provision is found to be invalid, the remaining provisions shall remain in effect.
19. Applicable Law and Disputes
Agreements with Forelle are governed by Dutch law.
This choice of law does not limit any mandatory consumer rights the customer has under the laws of the country in which the customer normally resides.
Forelle will always first seek to find a suitable solution to any dispute together with the customer. If this is unsuccessful, disputes will be submitted to the court that has jurisdiction under the applicable legal rules.
